The Silencer Shop ruling changed how a lot of people buy a suppressor, but whether it changes anything for you comes down to three things: your state, how you buy, and which process your dealer has chosen.

In 27 states, buying an Angstadt suppressor through Silencer Shop can mean a simple 4473 and a background check, with no NFA registration, if your dealer has opted into that process.

Everywhere else, or when your dealer keeps the old process, the standard Form 4 still applies, now at a $0 tax.

Was the NFA struck down?

No, not across the board. A federal court ruled in August 2026 that the NFA registration requirement could not stand for suppressors and blocked its enforcement.

That order is narrow: it protects the plaintiffs in the case and their members and customers, not the general public by default.

Why Silencer Shop matters here

Silencer Shop Foundation was a plaintiff, and the ruling covers a plaintiff’s customers, current and future, with no membership required. Silencer Shop is one of our distributors, so an Angstadt suppressor bought through Silencer Shop or a Silencer Shop authorized dealer runs through a covered channel.

That is what lets a buyer in a free state skip NFA registration and complete a normal 4473 instead.

Free states, NFA states, and banned states

Where you live decides which path is even on the table. The country falls into three groups after this ruling.

State law did not change with this ruling. A banned state is still banned, and an NFA state still runs the Form 4. The federal ruling opened the 4473 path only in the free states, and even there it is not automatic.

Buying direct through Angstadt

Because Silencer Shop was a plaintiff, buying an Angstadt can through Silencer Shop or one of its authorized dealers puts you in the covered channel. In a free state, that opens the door to a 4473 and a NICS background check at the dealer instead of the NFA process, the same as buying a rifle.

Whether you actually get that path depends on your dealer, which is the part most people miss.

Why it still depends on your dealer

In the free states, each dealer decides for itself which process to run. Some have switched to the 4473 route, with no Form 4, no fingerprints, and no wait. Others are still running the old NFA process by choice, fingerprints and ATF approval included.

That is a dealer decision, not a legal requirement, and you cannot force a dealer to switch. Before you count on the quick path, call your dealer and ask which process they are using. If they have not opted in, you can still buy the can, it just runs as a Form 4.

Does this change the $0 tax stamp?

No, and the two are easy to mix up. The $0 transfer tax has applied to every suppressor buyer since January 1, 2026, everywhere suppressors are legal. The court ruling is separate: it can remove the registration step for covered buyers in free states, not the tax for everyone.

Is the ruling final?

Not yet. The order took effect in August 2026, but the government has until early October 2026 to appeal, and the case could move for months. Treat the free state path as live and subject to change, and confirm your own situation with the dealer or an attorney before you count on it.
